These terms govern the use of branflow.digital and provide the general framework for requesting and engaging strategy, design and digital development services.
Identity and contact
Branflow Digital provides digital design and development services. Commercial and legal inquiries are received at brandontorres.dev@gmail.com. Formal provider, invoicing and jurisdiction details will be stated in each proposal or contract.
Use of this website
The website is informational and presents services, methodology and completed work. It does not by itself constitute an irrevocable offer, a guarantee of results or legal, financial or commercial advice.
Proposals and engagement
Sending an inquiry does not automatically create a contractual relationship. An engagement begins when both parties accept a written proposal identifying, at minimum:
- scope and deliverables;
- price, taxes and payment terms;
- stages, estimated timelines and responsibilities;
- third-party services and recurring costs;
- support, change and termination conditions.
Client responsibilities
The client must provide the content, access, feedback and permissions required for the work in a timely manner. The client also confirms having sufficient rights to any trademarks, text, images, databases or materials requested for inclusion.
Timelines and changes
Timelines are estimated according to scope and depend on timely materials and approvals. Requests that change the original scope may require a revised estimate of time and cost before implementation.
Payments, cancellations and refunds
Payment milestones, deposits, cancellations and any applicable refunds are defined in each proposal. Nothing in these terms limits non-waivable rights granted under applicable law.
Intellectual property
Branflow retains ownership of pre-existing methods, tools, reusable components and know-how. The license or assignment of project-specific deliverables is governed by the accepted proposal and normally becomes effective after full payment. Third-party software and services remain subject to their own licenses.
Third-party services
Domains, hosting, payment providers, email, analytics and integrations may rely on external providers. Their prices, availability, terms and policies are independent of Branflow unless a proposal expressly states otherwise.
Warranty and support
Review of development errors and post-launch support are provided for the period defined in each proposal. Content changes, new capabilities or incidents caused by third parties may be quoted separately.
Portfolio and confidentiality
A project may be featured after it becomes public or the client provides authorization. Information identified as confidential will not be disclosed unless required by law or expressly authorized.
Liability and applicable law
Each party remains responsible for its own obligations. Any limitation of liability is interpreted under applicable law and does not affect rights that cannot legally be waived. The accepted proposal prevails if it conflicts with these general terms.
Changes to these terms
Branflow may update this document to reflect changes in services or legal requirements. Unless otherwise agreed in writing, the version in effect when a project is engaged will apply.
